The landlord has applied for rent arrears, water rates and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent and water rates?

The tenancy ended on 30 August 2024. The landlord provided rent records, which record the amount owing on this date as $16,585.72. At the hearing, Pro Edge Property Management Limited advised the Tribunal that they sought a refund of the bond of $3,440.00. Subsequent enquiries made with Pro Edge Property Management Limited by the Tribunal after the hearing requesting the bond number revealed that the landlord had not lodged the bond. Pro Edge Property Management Limited advised the Tribunal that when they began managing the tenancy, they were under the assumption that the bond had been lodged by the landlord. Pro Edge Property Management Limited advised the Tribunal that they later discovered it had not, as the landlord had had experienced difficulty getting the tenant to sign the bond lodgement form. Pro Edge Property Management Limited advised that the bond was “currently on hold with the landlord.” The landlord should be aware that a tenant’s signature is not required to lodge a bond. Section 19(2) and (3) of the Residential Tenancies Act 1986 record that it is an unlawful act and infringement offence to not lodge a bond. This issue was not brought to light during the hearing and I therefore do not intend to make an order against the landlord for failing to lodge the bond however, it is appropriate that the bond amount of $3,440.00 be deducted from the total rent arrears owed by the tenant. It is for this reason that the total rent arrears to 30 August 2024 have been calculated as $13,145.72.
The landlord provided invoices from the water rates authority, which prove outstanding water rates totalled $746.19 at the end of the tenancy.
Because Pro Edge Property Management Limited has wholly succeeded with the claim I must reimburse the filing fee.
