Nicholas Purdon must pay rent and the debt as follows: a. By one payment of $3,170.00, being $770.00 for rent and $2,400.00 for the debt, by Thursday 15 August 2024. b. A final payment of $1,225.82, being $770.00 for rent and $455.82 for the debt, by Thursday 29 August 2024.
Payments will be allocated in the following order: rent, rent arrears, and the filing fee.
If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at 726 New North Road, Mount Albert, Auckland 1025 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
If the tenant fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.

Reasons

The landlord’s agent attended the hearing in-person. The tenant attended via telephone.
The landlord’s agent has applied for termination of the tenancy, rent arrears and refund of the bond. In the application form, the landlord’s agent had indicated a conditional termination may be acceptable and confirmed that position at the hearing.
The tenant confirmed they wish to repay the debt to avoid immediate termination and both parties agreed to the terms of the conditional termination as set out above.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
The amount owed in rent arrears as sought by the landlord’s agent was accepted by the tenant. The tenant has previously fallen into rent arrears and managed to repay the arrears via weekly instalments. That was some years ago, in 2020, when the tenant’s income was affected by Covid restrictions. The tenant confirmed his preference was to make two lump sum instalments to repay the debt, and confirmed the amounts and timing of those payments were feasible for his household.
The debt for water rates as sought by the landlord’s agent was accepted by the tenant. The landlord’s agent advised there are two homes on the property, therefore the water rates are calculated based on each separate home’s consumption.
Given the parties both consent, I am satisfied a conditional termination order is appropriate. I have granted a conditional termination order.
The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
As the applicant succeeded with the claim the tenant must reimburse the filing fee.
