In an email to the tenant dated 20 July 2023 the landlord accepted that notice had been given on 11 July 2024 to end the tenancy and so the tenancy would end 3 weeks later, on 1 August 2024. The Tribunal infers that the tenancy was terminated by agreement on that day.
The landlord provided rent records which prove the amount owing at the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit.
The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish. The costs claimed are reasonable based on the amount of rubbish shown on the landlord’s photographs. The premises would have required general cleaning after removal of the tenant’s belongings.
The tenant did not return the keys. The tenant had also placed a new entry lock on the garage. The locks had to be changed to secure the property.
At the end of the tenancy the blinds in the dining room, 3 sets of curtains from the lounge, the fridge and the microwave oven were missing. All these items except the blinds were listed as chattels in the tenancy agreement. The cost of replacement furnishings is $1,345.00.
Where the tenant makes an alteration to the premises with the landlord’s consent, then on or before expiry of the tenancy, the tenant must return the premises to a condition that is substantially the same as the condition the premises were in prior to the “minor change” being made.
The tenant painted several walls in the house and did not return the premises to substantially the same condition before vacating. The landlord repainted the walls himself and claims the cost of materials, which is awarded.
The landlord found non-compliant wiring loose in the garage that had been installed by the tenant. The cost for an electrician to remedy was $134.21.
A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission.
The rear entrance glass was broken at the end of the tenancy. The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage. The amount claimed is less than the insurance excess of $1,250.00. Filing fee and name suppression
