The Bond Centre is to pay the bond of $400.00 ([Bond number suppressed]) to [The landlord/s] immediately.

Reasons

The landlord attended the hearing, the tenant did not attend.

However, I note that this hearing was set down for a videoconference. There were three separate claims to be heard together application numbers 4888182, 4981348, 4991568.

At the start of the hearing, I could not access either party by video. The Tribunal had cancelled application numbers 4888182 and 4981348 in the system. The only active claim appeared to be the tenants, 4991568.

The landlord was claiming rent arrears and for the bond from a previous tenancy to be transferred to the tenancy.

The tenancy has now ended.

The tenant had an application before the Tribunal for a refund of power bills and to complain of breach of healthy homes standards regarding draughter stopping. As the tenant did not attend the hearing, I cannot consider his claims. Power bill refund:

However, the landlord has now offered to repay all the power the tenant paid during the tenancy, which was a big part of the tenant’s application.

The landlord provided detailed invoices for all the power bills during the tenancy paid by the tenant. I have deleted all the surcharge fees and the late fees from the actual invoices. The total compensation for power bills is $2259.82. I award this sum to the tenant for the power bills he paid during the tenancy.

The tenant advised the Tribunal several days ago that he was unable to attend the hearing. I am dismissing the tenants claims as he has not attended the hearing nor given an adequate explanation for his non-attendance. Rent arrears:

The landlord has applied for rent arrears and has provided rent records which prove the amount $2697.14 owing in rent arrears to the end of the tenancy.

I am satisfied that the landlord has proven their claim for rent arrears. Bond transfer:

The landlord said that the tenant has been a previous tenant at another property. When the tenant moved into this new tenancy the existing bond from the previous house was to be transferred. The transfer did not happen, but the tenant did pay an additional $400.00 bond for the new tenancy at this property.

The landlord has lodged the $400.00 at the bond centre. The previous bond of the tenants remains under the old property.

Given the small amount of money owing to the landlord by the tenant, I am not ordering the previous bond be transfer to the landlord.

The tenant will need to seek a refund of the previous bond from the bond centre and ensure he pays the landlord the remaining outstanding sum ordered in the order of $64.32. Suppression and filing fee:

The landlord has requested suppression of their name and identifying details. As they have been successful, I am granting suppression.

Because Thomas Stephen Ferguson has wholly succeeded with the claim I must reimburse the filing fee.
