I am satisfied that the walls in Mr Marshall’s bedroom were damaged during the tenancy, in particular, by a hole. The damage to the premises occurred during the tenancy, is more than fair wear and tear, and Mr Marshall has not disproved liability for it: sections 40(2)(a), 41 and 49B of the Act.
The amount claimed has been established by the production of an invoice. The amount claimed has been reduced to account for betterment or depreciation.
