The landlord has applied for rent arrears, compensation, and reimbursement of the filing fee following the end of the tenancy. Rent
The tenancy was terminated on 1 August 2024 pursuant to a Tribunal order. The Tribunal held that the premises had been abandoned.
The tenancy was for a fixed term expiring on 15 November 2024. Pursuant to section 61(3)(b) of the Residential Tenancies Act 1986, the landlord is entitled to rent to the end of the fixed term. The premises have been advertised but have not been relet to new tenants. The landlord provided a rent summary showing the rent arrears to the end of the tenancy.
I note that the bond has already been applied towards the rent arrears. Cleaning and rubbish removal
At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit.
The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish. The premises had been used for the illegal purpose of growing marijuana. The house was full of belongings and equipment. The carpet needed cleaning in several rooms. The house required general cleaning after removal of the belongings and equipment. Damage
A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission.
Tenants are liable for the cost of repairing damage that is intentional or which results from any activity at the premises that is an imprisonable offence. This applies to anything the tenant does and anything done by a person they are responsible for.
The carpet was badly damaged by mould in two rooms and had to be replaced. The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage.
The power was disconnected when the Police raided the premises. There were various inspection costs involved in reconnecting the power. These are awarded. Filing fee and name suppression
