Reasons

The landlord attended the hearing by remote teleconference. Two attempts were made to contact the tenant on the telephone number provided. Both attempts were unsuccessful.
The landlord has applied for vacated compensation and reimbursement of the filing fee following the end of the tenancy.
The tenancy ended on 19 July 2024. The tenant provided 28 days’ notice on 18 June 2024.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish. Photographic evidence provided with the application shows significant personal belongings and furniture left behind by the tenant at the end of the tenancy. The oven was also left in an unacceptable state.
The tenant did not return the keys. The landlord stated during the hearing that they needed to replace all locks.
The landlord provided photographic evidence in support of these claims along with itemised expense receipts. Having sighted this evidence I am satisfied that the tenant breached his obligations in respect of these claims at the end of the tenancy.
The landlord confirmed that the bond of $212.00 has been released to them. This amount has been applied to the debt. The landlord also advised of a rent credit of $86.57. This amount has also been applied to the tenant’s debt as recorded above.
The amounts ordered are proved.
Because Otautahi Community Housing Trust has wholly succeeded with the claim I must reimburse the filing fee.
