The Bond Centre is to pay the bond of $3,800.00 (6520988-014) to Max Rentals Nz Limited As Agent For Rakesh Kumar immediately.
[The tenant/s] must pay Max Rentals Nz Limited As Agent For Rakesh Kumar $21,636.70 immediately, calculated as shown in the table below:

Reasons

This application was scheduled to be heard by video conference. Ms Vaihola did not link to the Teams Link and nor did she answer the two calls I made to the mobile number provided for her. The hearing proceeded in her absence.
The landlord has applied for termination of the tenancy, rent arrears, water rates, reimbursement of the filing fee and payment of the bond.
Rent was at least 21 days in arrears on the date the application was filed and so I must terminate the tenancy. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which show that as at yesterday’s date $20,192.86 is owing in rent.
However at today’s hearing the landlord advised that they had made two rent payments on behalf of Ms Vaihola because they trusted that she would pay them back from her KiwiSaver account and or the sale of a car.
The landlord advised that they had made one $5,000.00 payment towards the rent on 15 August 2024 and a further $1,000.00 payment on 19 September 2024. The landlord states that because they had made these payments themselves, that in fact there is an amount of $26,912.86 owing in rent.
I accept the evidence indicating that the landlord made a $5,000.00 payment in rent for Ms Vaihola on 15 August 2024 and she is therefore required to pay it back. This means that the rent arrears as at 21 January 2025 is in fact $25,192.86 and not $20,192.86.
The landlord has been unable to prove their payment of $1,000.00 rent on Ms Vaihola’s behalf on 19 September 2024 and so I am not ordering Ms Vaihola to repay this amount.
The landlord has proven that as at today’s date that there is $216.84 outstanding in water rates and Ms Vaihola is also ordered to pay this amount.
Further to this Ms Vaihola is required to reimburse the filing fee to the landlord because the landlord was substantially successful in the claim against her. C ter Haar 22 January 2025
