Reasons

The landlord attended the hearing which was held by teleconference. The Tribunal was unable to contact the tenant on the contact number provided in the application. I am satisfied adequate service of the hearing notice has been completed and considered it reasonable to proceed with the hearing in the tenant’s absence.
The landlord has applied for compensation and reimbursement of the filing fee following the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986 (“RTA”).
The landlord has applied for compensation comprising $488.75 for cleaning and $272.50 for rubbish removal. Based on the evidence provided, the landlord has established that the tenant failed to comply with their obligations under the RTA to leave the premises reasonably clean and tidy and to remove all rubbish at the end of the tenancy. The tenant’s failure to meet these obligations constitutes a breach of their legal duties, making them liable for the costs incurred by the landlord to restore the property.
The landlord relied on the exit property inspection report, photographs, and invoices to substantiate the claim. The inspection report documented the condition of the premises at the end of the tenancy, showing that the property was left in an unclean and untidy state.
