The landlord has applied for compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy. The landlord said the tenancy ended on 23 September 2024.

Did the tenant comply with their obligations at the end of the tenancy?

Cleaning

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.

The landlord said the tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish.

The landlord set out separate claims for cleaning the stove, for which they claimed $190.81, cleaning the kitchen cupboards, for which they claimed $120.42 and cleaning the rest of the one-bedroom unit, for which they claimed $494.30, a total of which is $805.53. The landlord said the cleaning of the whole unit took around 6-8 hours and required two cleaners. The landlord provided a breakdown of the tasks involved in cleaning the stove, which included having to disassemble and disconnect the stove, with the assistance of an electrician, because the stove was in such a bad condition, so that the stove could be thoroughly cleaned and reassembled.

The landlord provided photographs taken on 23 September 2024, the last day of the tenancy, showing the condition of the property then. The photographs of the stove, show an extreme condition of a stove covered in dirt and black grime in multiple layers on the stove top and inside the oven. The photographs of the condition of the kitchen cupboard show many cupboards caked with dirt and grime. The photographs of the rest of the unit show an extreme condition of dirtiness, with numerous discarded cigarette ends overflowing on a cupboard and in its drawers, significant dirt and rubbish discarded throughout the unit, a very dirty toilet and bathroom. The photographs of the kitchen bench showed many discarded items left on the bench piling up on each other, overflowing so that the bench is barely visible. The landlord provided an invoice for the job amount claimed by Clean-up Canterbury Limited for cleaning work, confirming the amounts claimed were paid by the landlord to the cleaning contractor.

From the extreme condition of the stove, oven, kitchen cupboards and the entire unit showed in the photographs provided, I find the total cleaning cost claimed of $805.53 completed using 2 cleaners in a full day or more, to be reasonable. I award this to the landlord for cleaning at the end of the tenancy. Rubbish removal

The landlord claimed $1,102.45 for rubbish removal and said 7 cubic metres of rubbish were removed from the property, which included a bed, mattresses, couch, fridge, washing machine, and the contents of all the cupboards and drawers at the property. The landlord provided photographs of all the rubbish removed by them at the end of the tenancy, indicated the cost per cubic metre for the labour hours, any dump fees or skips, was $136.95 x 7 cubic metres, which came to $958.65 exclusive of GST. The GST inclusive claim was for $1,102.45. The landlord provided an invoice for the job amount claimed which they paid to Clean-up Canterbury Limited to remove and dump all the rubbish. Given this involved several large items, which apparently required 2 people to remove and clear all the rubbish and dump it, and which would have taken some time to clear, remove and dump, I find the cost claimed by the landlord of $1,102.45, to be reasonable, given the evidence provided of the photographs of the extensive rubbish left at the end of the tenancy. Locks replacement

The landlord said the tenant did not return 3 sets of keys. Whilst the landlord said they were charged $429.36 to have the front and back door locks replaced, they said they discounted what they were charged and only wanted to claim $172.50 from the tenant to change the locks. I find this amount of $172.50 (GST inclusive) to be reasonable, given the evidence and award this to the landlord to replace the locks.

The amounts ordered are proved. Refund of the bond

The landlord initially claimed for a refund of the bond in their application but said that they had received the bond of $216.00 from the Bond Centre in November 2024, shortly after filing the application and so hold this amount in their account currently. They requested a formal order that the bond can be refunded to them to set off any monetary amount owed by the tenant. Tenant credits

The landlord said further that the tenant has paid them a total of $210.00 to 27 January 2025, in payments of $15.00 per week, towards any damages remaining at the end of the tenant. The landlord would like this amount to be credited to the tenant in this order, and provided a statement of account which showed the tenants’ payments to 27 January 2025.

The landlord also provided a rent summary to the end of the tenancy, which showed a credit to the tenant of $23.57 at the end of the tenancy. The landlord wanted this credit to also form part of this order. Filing fee

Because Otautahi Community Housing Trust has wholly succeeded with the claim I must reimburse the filing fee.
