The landlord attended the hearing via teleconference. The tenant did not.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated and possession is granted to Linkpeople Limited, at 5:00 pm on Monday 6 th January 2025. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing at the end of the tenancy. The rent owing to 6 th January 2025 is $1,368.00. I order the tenant to pay this amount to the landlord.
The landlord sought compensation for Heathcote’s call out fee, plumbing repair fee and for carpet drying.
There were invoices to prove that there was candle wax poured down the drain blocking it. A plumber was called to fix it but not before the carpet being flooded due to it. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B Residential Tenancies Act 1986. I find the act of pouring candle wax down the drain is intentional damage and the tenant is liable to pay for damage arising from it.
I order the tenant to pay the landlord $235.75 for the plumber’s fee and $1,943.50 for carpet drying. The tenant had already paid $220.00 towards this. I order the tenant to pay $1,723.50 for the carpet drying.
There was a further $115.00 incurred when Heathcote’s was called out for the plumbing issue. The tenant did not allow access at the time.
