The Tribunal called the tenant several times on the telephone numbers for her in the application, but the calls diverted to voicemail. I am satisfied that the tenant was served with notice of the hearing and chose not to attend.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
The tenant sent an email to the landlord on 18 November 2024 advising that she intended to give notice to end the tenancy. She did not specify an end date. The landlord replied advising that she would need to give 28 days’ notice in writing and specify the end date. The tenant did not send the landlord any further notice specifying the last day of the tenancy.
On 28 November 2024 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. A call was received from neighbours advising that there was a broken window at the house and the garage door was open. The landlord attended the property and found that the tenant had removed most of her belongings from the house and vacated as shown in photos produced in evidence. The landlord secured the property by changing the locks and immediately left messages for the tenant advising her of what they had done and inviting her to contact them to uplift keys to the property. However, she did not respond. In the meantime, the rent went into arrears.
Because the premises have been abandoned, and rent is in arrears, the tenancy is terminated immediately.
