Reasons

The landlord attended the hearing, which was conducted by video conference. At least two attempts were made to contact the tenant and the guarantor by telephone. These attempts were unsuccessful. The tenant and the guarantor have not communicated with the Tribunal as to why they would not attend the hearing and the hearing proceeded in their absence.
The landlord has applied for termination of the tenancy, rent arrears and unpaid water rates.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated in accordance with section 55(1)(a) of the Residential Tenancies Act 1986 (RTA).
The landlord provided rent records in the form of a rent ledger which prove the amount of rent owing at the end of the tenancy. The landlord also provided invoices showing the amount of unpaid water rates owing at the end of the tenancy.
On 13 August 2024, the guarantor provided a guarantee to the landlord, which undertook that the guarantor would be liable for any breach of the tenant's obligations relating to the tenancy.
The Tribunal has ordered the tenant to pay $11,453.17 to the landlord for the tenant’s breaches, which are all matters covered by the guarantee.
I am therefore satisfied that the guarantor is liable under the guarantee to pay the landlord the sum ordered. (See section 77(2)(ka) of the RTA.)
Prestige Realty Limited - As Agent For Yingqian Yu has wholly succeeded with the claim. Therefore, I must order reimbursement of the filing fee.
