Reasons

The landlord attended the hearing, the tenants did not attend. I rang both tenants twice each and the calls went to answerphone. I have checked and see that the tenants were sent a notice of hearing. Therefore, I am conducting the hearing in their absence.
The landlord has applied for termination of the tenancy, rent arrears, water bills, reimbursement of the filing fee and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
Throughout the tenancy there has had ongoing rent arrears issues and a failure to paid water bills. Despite frequent 14 day notices to remedy breaches for invoice and rent arrears, plus emails and text reminders, the tenants have not remedied the situation. In these circumstances I have no option than to terminate the tenancy.
The tenancy will terminate at 11.59pm on Monday 6 th January 2025. The landlord will gain immediate possession of the property after that date and time.
The landlord provided rent records which prove the amount owing at the time of the hearing. As of 13 December 2024, the rent arrears are $1567.04 and water bills are $1098.33.
I am satisfied that the landlord has proven their claim for rent arrears and water bills.
The Bond Centre is to refund the bond to the landlord to offset the debt owed by the tenants to the landlord.
It is hoped that the tenants continue to make payments towards the rent over the period of the remaining tenancy. If not, the landlord will be seeking additional rent arrears after termination if the rent was not paid over this period.
The landlord has sought suppression of their name and identifying details and as they have been successful, I am granting suppression.
Because the landlord has been wholly successful with their claim, I must reimburse the filing fee.
