The hearing was held on 4 June 2025.

The tenancy commenced on 3 December 2023 and ended on 28 October 2024.

The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

During the hearing, [the landlord’s representative] confirmed that the bond was released to the landlord by consent. Ms. Antonio-Rooney did not dispute this.

Ms Antonio-Rooney stated that she did not dispute rent and water arrears. However, she did not accept the claims against her for oven cleaning and rubbish removal.

See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.

At the heart of this dispute is Ms. Antonio-Rooney’s claim that the oven glass was not clean when she moved in and that the rubbish left behind was not hers.

[The landlord’s representative] submitted a pre-tenancy inspection report dated 9 October 2023. The photos in the report showed that both the oven glass and the oven tray were clean, with no oil on the glass or leftover food in the tray.

Accordingly, I am satisfied on the balance of probabilities that Ms Antonio- Rooney did not leave the premises reasonably clean and tidy (in relation to the oven).

However, I am not satisfied that Ms. Antonio-Rooney failed to remove all the rubbish because I lack sufficient evidence to make such a finding. The evidence before me consists of a 4-page report (out of 36 pages) labelled “Exit Condition Report” in the top right-hand corner. The submitted evidence fails to demonstrate rubbish on the premises. Accordingly, the claim against Ms. Antonio-Rooney for not removing rubbish is dismissed.

At the time of the hearing, [the landlord’s representative] was unable to locate the invoice supporting the compensation claims because the file had been archived. [The landlord’s representative] stated that she would need to contact the service provider to obtain a copy of the invoice. She requested additional time to provide it and confirmed that she would be able to submit the invoice by 5 pm on 5 June 2025.

At the time of writing this decision, I have not received the invoice. Accordingly, the amounts claimed by [the landlord’s representative] have not been proven. Filing fee
