Reasons

Only the applicant attended the hearing. The tenant did not. On 18/3/2025 she had messaged requesting an adjournment as she did not envisage being well enough to attend. Her request was declined. It was not supported by medical evidence, and it was considered premature for her to have made that request.
No further request was made and no medical or any other evidence provided.
The Tribunal proceeded to consider the issues raised in her absence, noting that it is charged with resolving disputes fairly as regards both parties and in an expeditious manner.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The tenancy was for a fixed term due to end in February 2026. The parties agreed it would end early; initially on 15/12/2024, however that date was pushed out and ultimately it was on 8/1/2025, that the tenant finally confirmed she had left. The rent is calculated until 6/1/2025. Mr McLeod said he would claim rent until the end of the previous rental week and waive the additional two days rent, he could have claimed.
The landlord provided rent records which prove the amount owing at the end of the tenancy. He confirmed that no payments had been received since then and the bond has subsequently been refunded to him.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish. The photographs provided show that the flat was left in a very untidy and filthy condition. Extensive cleaning and rubbish removal (and removal of the tenant’s items) was required.
The amount claimed (and that the landlord paid) is reduced by $365, which is a generous deduction. It takes account of the fact that the Act states that a tenant need only leave a property in a reasonable condition, it does not need to be immaculate or left so it can be immediately relet. The
Several chattels provided at the beginning of the tenancy, were missing at the end of the tenancy and others were left in a very dirty condition and disposed ot. Three pot plants were dead. Mr McLeod said he would waive these claims (that clearly could have been made) in the interests of resolving this matter. If the tenant applies for a rehearing or makes further claims in relation to the tenancy, then he reserves the right to claim all rent, full compensation and replacement of chattels.
The amounts ordered are proved.
Because Luke McLeod has wholly succeeded with the claim I must reimburse the filing fee.
No request for name suppression was made.
