The landlord provided records to show the tenant did not pay water rates for water consumed in August 2024 and December 2024. The landlord provided records to show the tenant only paid part of the total water rates for water consumed in July 2024. As at 16 December 2024, the tenant owed $370.05 in unpaid water rates for water consumed during the tenancy.

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy. See section 40(1)(e)(ii)-(v) of the Residential Tenancies Act 1986.
The landlord says the tenant did not leave the premises reasonably clean and tidy, in that there were fleas in the carpet, particularly in the lounge and master bedroom.
The landlord says when they went to the property on 17 December 2024 to conduct the exit inspection, fleas were in the carpet, particularly the carpet in the lounge and master bedroom. The landlord says she spent approximately 1.5 hrs at the property on that occasion, during which she could feel the fleas jumping on her legs and feet. At the end of her visit, she says she had visible bites on her legs and feet.
The landlord produced an invoice dated 17 December 2024 as evidence she purchased a flea bomb from Mitre 10 for $12.99. The landlord returned to the premises on 18 December 2024 to activate the flea bomb.
The amounts ordered are proved.
The landlord’s application sought payment of $120.00 for lawn mowing, however, at the hearing the landlord advised that was no longer sought. I dismiss the claim for the cost of lawn mowing. Should the tenant reimburse the landlord’s application fee?
As the landlord has succeeded with the claim the tenant must reimburse the filing fee.
