Reasons

The hearing was conducted on Microsoft Teams.
Sunil Singh of The Rent Shop Limited attended for the landlord.
The tenant did not attend. The hearing proceeded in their absence.
The landlord originally applied for termination of the tenancy for breach of the tenant’s obligations and rent arrears. However, today Mr Singh sought only conditional termination, arrears, an order for rent in advance, and the filing fee.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. 1
Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.
The tenant has breached their obligations in respect to paying rent.
The landlord served a 14-day notice on the tenant and the tenant did not remedy the breach within the required period.
However, on this occasion, I am not satisfied it would be inequitable to refuse to terminate the tenancy, albeit that today Mr Singh sought only conditional termination.
My conclusion on termination might be different, if the tenant does not comply with this order and pay rent on time in future, leading to a further application. Rent arrears and rent in advance
The tenant must bring their rent payments into line with their obligations to pay rent on time. To ensure this, they must pay rent in advance or naturally they will continue to be in arrears.
Therefore, the Tribunal orders the tenant to pay the rent arrears due to today and also the two days’ of rent in advance that is overdue.
If the tenant does not meet the Tribunal’s order and continue to pay their rent every Thursday (including this Thursday), the landlord is welcome to bring a further application for termination. If the landlord does have to bring another application, the Tribunal is liable to look at a request for termination favourably. In other words, it is in the tenant’s interests to pay their rent on time. Otherwise, the Tribunal may be minded to terminating the tenancy if the landlord has to bring another application of this kind. 1 See section 56(1) of the Residential Tenancies Act 1986. Filing fee
