Reasons

The hearing was conducted by teleconference. Both parties attended.
The landlord has filed an application seeking orders for outstanding rent arrears totalling $7,457.00, unpaid water charges of $520.45, and compensation for damage to the property in the sum of $24,092.50 following the end of the tenancy.
In support of the claim, the landlord provided a detailed rent ledger confirming the arrears, water invoices, and an itemised invoice for repair work and replacement costs. These include costs associated with removing rubbish, repairing damage to internal walls and doors, replacing broken windows, and the replacement of the carpet and oven. The landlord also submitted extensive photographic evidence showing widespread and severe damage to the premises. The images clearly depict holes in multiple walls and doors, drawings on interior surfaces, broken windows, soiled and stained carpet, and an oven rendered inoperable. The nature and extent of the damage go well beyond fair wear and tear.
At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
Under sections 40(2)(a), 41, and 49B RTA, tenants are liable for any intentional or careless damage caused during the tenancy, including damage caused by persons present at the premises with the tenant’s permission. A landlord must prove that the damage occurred during the tenancy and that it exceeds normal wear and tear. Once that is established, the burden shifts to the tenant to prove the damage was not intentionally or carelessly caused.
In this case, the evidence clearly supports the landlord’s claims that rubbish was left at the premises at the end of the tenancy and substantial and costly damage was caused to the property, and no evidence has been presented to the contrary.
At the hearing, the tenant expressly agreed to all aspects of the landlord’s claim. This matter therefore proceeds by consent. The tenant advised that she receives assistance through Work and Income New Zealand (Ministry of Social Development) and intends to liaise with her case manager to arrange for payment of the outstanding costs through available ‘Tenancy Costs Cover’. While the Tribunal cannot direct the Ministry to prioritise payment, it is noted for the record that the landlord would appreciate consideration being given to the timely processing of this matter by Work and Income.
As the landlord has been wholly successful in their application, the Tribunal makes an order under section 102 of the RTA requiring the tenant to reimburse the Tribunal filing fee. In accordance with section 95A, the landlord is also entitled to suppression of their name and identifying details.
Given the nature and background of the matter, including the tenant’s financial vulnerability and the fact that the orders are made by consent, I consider it just and reasonable to grant suppression of the tenant’s name and identifying details.
This decision is therefore issued as a consent order, with full orders made for the amounts claimed, and appropriate name suppression granted to both parties.
