Both parties attended the hearing.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
The parties agreed for the Tenant to pay the Landlord for rent arrears, cleaning and repairs to the sleepout window.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The Landlord claimed for garden work due to the Tenant leaving the lawns and garden overgrown with excessive weeds. Photographs were provided of the garden at the end of the tenancy, start of the tenancy and during the tenancy. These were accompanied by remarks which stated that they were overgrown and required maintenance. An invoice was also provided to substantiate the work. The Landlord also issued 14-day notices because of the lack of maintenance by the Tenants during the tenancy.
The Tenant claimed the gardens were not in a reasonable condition when she moved in. The ingoing photographs did not show the gardens behind the shed. She left the garden how she found it.
In considering the evidence, the Landlord has provided ingoing, mid-tenancy, outgoing inspection reports and 14-day notices which prove it more likely than not that the garden required maintenance. This is from observing photographs in all the inspection reports. Although the Tenant submitted the gardens were not clean and tidy at the start of the tenancy, the photographs did not substantiate this.
The amounts ordered are proved.
As both parties have enjoyed some success to an extent, name suppression is granted to both parties and the Tenant shall reimburse the filing fee to the Landlord.
