The landlord attended the hearing by video. The tenant did not attend the hearing. An attempt was made to call the tenant for the hearing, but the call was not answered. As I am satisfied that the tenant had notice of the hearing the hearing proceeded in his absence.

The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

This is a fixed term tenancy due to end on 4 November 2025. The tenant left the tenancy around 15 January 2025, however his liability extends to either the end of the fixed term or the start of a new tenancy.

The landlord advised that a new tenancy commenced on 7 February 2025. The tenant is therefore liable for rent up to and including 6 February 2025.

Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
