Reasons

Only the applicant attended the hearing which took place by teleconference. The tenant was called on two numbers provided and both numbers went to voicemail. The file records that notice of the hearing was sent to the tenant so the hearing proceeded.
The landlord has applied for termination of the tenancy, rent and water arrears and reimbursement of the filing fee.
The tenancy was terminated by the Tribunal on 19 March 2025 and adjourned for further evidence to be filed before rent and water arrears could be determined.
There is no written tenancy agreement in respect of this tenancy. No tenancy agreement is unenforceable on the grounds that it is not in writing. See section 13C Residential Tenancies Act 1986.
The landlord advised that the parties entered in to verbal tenancy agreement following the termination of a previous tenancy. The landlord advised that once the previous tenancy was terminated it was discovered that the respondent was living in the premises and there was agreement that she could remain and become the tenant.
The landlord has filed a copy of messaging between the previous property management company and the tenant. In particular a message dated 20 July which states “Hello Michelle Your tenancy period is from 16/06/2023. We will renew every three months, the rent is $500 a week plus water. Feel free to contact me if more information is needed. Regards [property manager]” and then there is a reply “Great thank you [property manager]”.
The landlord has also filed bank statements recording rent payments from the tenant commencing on 16 June 2023 and an email from MSD to the property manager and the tenant in August 2023 regarding rent arrears on the property.
I have considered the evidence and find on the balance of probabilities that this tenancy commenced on 16 June 2023.
The landlord provided evidence that possession was returned to the landlord on 7 April 2025.
The landlord has provided rent and water statements to the Tribunal. The amounts are ordered as sought.
Because the landlord has wholly succeeded with the claim, I must reimburse the filing fee and suppress the landlord details in the order as applied for. See sections 102(4) and 95A(1) Residential Tenancies Act 1986.
