Only the landlord’s representative attended the hearing. There was no appearance by or for the tenants or guarantor.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
This was a five-year tenancy which ended on 14 February 2025 after the tenants gave written notice. The landlord provided rent records which prove the amount owing at the end of the tenancy and this is awarded. Cleaning and repairs
A tenant is required to leave tenancy premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The landlord supplied photographs taken at the end of the tenancy that prove that:- a. the tenants did not leave the premises reasonably clean and tidy, and did not remove all rubbish; b. not all of the house keys were returned; c. several of the curtains were stained or marked; d. there was a deep, circular burn mark (about the size of a 10 cent piece) in the middle of the lounge carpet and several stained areas in this room.
The premises were brand new at the start of the tenancy.
I am satisfied that cleaning and specialist curtain cleaning were required and award the costs based on the receipts supplied.
I award the claim to rekey the locks to secure the property and provide replacement keys.
The lounge carpet was carelessly damaged during the tenancy. The landlord holds insurance and an excess of $400.00 was charged. The tenant is liable to pay the excess.
I award the filing fee on the claim. Bond and suppression
The bond is refunded to the landlord and a balance of $970.74 is payable by the tenants and/or guarantor.
I suppress the landlord’s name as sought as it has wholly succeeded with the claims.
