Reasons

The tenancy commenced on 11 March 2024 for a fixed term, and due to end on 11 March 2025. On or about 7 November 2024 the parties agreed to end the tenancy. The tenant agreed to remain liable for rent until the landlord entered into a new tenancy agreement and reasonable costs associated with reletting the property.
The landlord entered into a new tenancy agreement on 25 November 2024. The landlord’s application for cleaning, carpet cleaning, rubbish removal, break lease fee, refund of the bond, and reimbursement of the filing fee was filed on 21 February 2025.
The matter was then scheduled for an audio-visual hearing with links sent to both parties. Today, [Office Manager] attempted to join the hearing but was unsuccessful. The tenant did not attempt to join the video hearing. The parties were then called on the phone numbers provided. The [Office Manager] appeared for the landlord. Unsuccessful attempts were made to contact the tenant on the numbers provided. Service
In this case the application was filed more than two months after the end of the tenancy, so the usual service rules no longer apply.
The application must be served either personally on the tenant, on someone over the age of 16 living at address where the tenant now lives, or by post to an address provided by the tenant within two months before the application was made. See section 91A(2) Residential Tenancies Act 1986 (the “Act”).
If the landlord cannot locate the tenant, despite making all reasonable efforts to do so, the landlord may apply to the Tribunal for a direction that the application is to be served by some other means likely to bring it to the tenant’s notice. Alternatively, the landlord may apply to the Tribunal for a direction that service be dispensed with. See section 91B the Act.
[ Office Manager] stated that shortly before filing the application the landlord made enquiries with Police who could not assist. The landlord contacted the tenant’s mother at a number provided in the tenant’s tenancy application form. She advised that she was unable to assist and did not know where abouts of her son and believed he had been moving around.
Having heard from the landlord I am satisfied that they have taken reasonable steps to locate the tenant but have been unsuccessful. I therefore dispense with service. Cleaning, carpet cleaning and rubbish removal
The landlord is claiming $230.00 for cleaning, $230.00 for carpet cleaning and $2,027.00 for rubbish removal.
At the end of the tenancy the tenant is required to leave the property reasonably clean and tidy and remove all rubbish.
The landlord has provided photographs of the interior and exterior at the end of the tenancy.
The landlord states that the tenant conducted a business from the property. It appears this was with the landlord’s consent. At the end of the tenancy the tenant undertook to remove rubbish associated with his business and other associated rubbish. The new tenant moved in, but the rubbish was not removed. On the 22 and 27 of January 2025, the landlord arranged for it to be removed. The removal involved a crane lifter, the weight of the material removed was approximately 4.5 tonnes. The amount claimed includes disposal fees. Having heard from the landlord and reviewed the photographs, I am satisfied that the tenant has failed to remove all rubbish and in the circumstances the amount claimed is reasonable.
The landlord is seeking $230.00 cleaning costs for cleaning of the windowsills, oven, bathrooms (two), cupboards and cobweb removal. The landlord filed with the application pre and post tenancy photographs showing the condition of the property at the commencement and end of the tenancy. The Tribunal can make a proper before and after comparison of the cleanliness of the property. Having heard from the landlord and reviewing the photographs, I am satisfied that the tenant has failed to leave the property reasonably clean and in the circumstances the amount claimed is reasonable and awarded.
The landlord is seeking $230.00 for carpet cleaning. The Tribunal has not been provided with a pre-tenancy inspection report or photographs showing the condition of the carpet at the commencement of the tenancy. Nor has the Tribunal been provided with a post-tenancy inspection report or photographs of the carpet at the end of the tenancy. Given the lack of evidence the claim for carpet cleaning is dismissed. Break lease fee
On 14 November 2024, the parties signed a break lease agreement under which the landlord could claim reasonable costs associated with reletting the property. A break down of the costs was provided to the tenant. Section 44 of the Act enables a landlord to recover reasonable expenses occurred in the early termination of the tenancy. I am satisfied that the costs claimed are reasonable and are awarded. Costs
Because [The applicant/s] has wholly succeeded with the claim I have reimbursed the filing fee. Name Suppression
Section 95A of the Residential Tenancies Act 1986 Act (the “Act”) provides that on the application of a party that has been wholly or substantially successful in proceedings, the Tribunal must order that the name or identifying particulars not be published, unless the Tribunal considers that it is in the public interest to publish the names of the parties, or is justified because of the parties’ conduct, or any other circumstances of the case.
