On 26 February 2025 the landlord applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
The bond was refunded to the landlord by the Bond Centre on or about 14 March 2025. Rent and Water
The tenancy ended on 3 February 2025 when the tenant was evicted pursuant to a mediated order. The landlord provided rent records and water invoices which prove the amount owing at the end of the tenancy.
The bond was applied towards the rent arrears and the balance to the water charges.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit.
The tenant did not leave the premises reasonably clean and tidy. The carpets were stained in several rooms including blood stains. There were food items on the kitchen bench and cleaning products in the kitchen cupboards. There were blood spots on the walls. Various personal items were strewn around, including a vacuum cleaner. The premises would have needed general cleaning following removal of these items.
The tenant did not remove all rubbish. Outside, large items of furniture, shelving, and pallets had been left behind.
The locks had to be changed following the eviction, which incurred a fee. Tenant Damage
A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission.
Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or four weeks' rent. The insurance excess was $400.00 with a weekly rent of $790.00.
Tenants are liable for the cost of repairing damage that is intentional or which results from any activity at the premises that is an imprisonable offence. This applies to anything the tenant does and anything done by a person they are responsible for.
Damage is intentional where a person intends to cause damage and takes the necessary steps to achieve that purpose. Damage is also intentional where a person does something, or allows a situation to continue, knowing that damage is a certainty.
The premises were badly damaged during the tenancy. A wooden balustrade on the upper landing was dismantled and piled in a corner. The slats on an internal door were removed and placed in the bath. There was damage to several internal doors and walls that required force. The door on a vanity was broken. Three out of four windows were missing from the exterior door leading to the deck, and windows were missing from the detached garage. The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage. Filing Fee and Suppression
