The landlord attended the hearing via remote video conference. The tenants did not attend the video conference. Attempts were then made to contact the tenants on the telephone numbers provided. The telephone calls to both numbers went unanswered.

The tenancy was terminated pursuant to an earlier Tenancy Tribunal order dated 27 February 2025. Although possession was returned to the landlord at 11:59pm 9 March 2025 the tenants did not vacate the property until 12 April 2025. The landlord advises that they did not have vacant possession until this date.

The landlord provided rent records which prove the amount owing at the end of the tenancy. The tenants are liable for rent payments up until such time as vacant possession is returned to the landlord.

Having sighted the landlord’s rent ledger I am satisfied that the tenants are responsible for the rent debt.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.

The landlord claims that the tenants did not leave the premises reasonably clean and tidy and did not remove all rubbish. The landlord provided comprehensive photographic evidence of the significant amount of rubbish left behind by the tenants. The property was also left in a state which can only be described as disgraceful. I have sighted a paid expense claim for $2200.00 dated 17 April 2025 from Busy Bee Limited. The invoice covers the amounts claimed for the work undertaken in respect of the lawns, garden and rubbish removal.

The tenants did not return the keys.

The amounts ordered are proved.

Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee.

The Tribunal must, on the application of a party that has wholly or substantially succeeded in proceedings, order that the party’s name or identifying particulars not be published, unless the Tribunal considers that publication is in the public interest or is justified because of the party’s conduct or any other circumstances of the case – section 95A Residential Tenancies Act.
