The landlord provided rent records and water rates invoices which prove the amount currently owing for rent arrears is $3,096.14 and for water rates is $253.35. The tenant agreed with these amounts.

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

The tenant stated that the tenancy has been a long one of almost four years, and that rent arrears only started accruing following a car accident she had in 2024. She said her employment was then made redundant. She has sought assistance from Work and Income New Zealand, Habitat for Humanity and Vakatautua. She stated that she is suffering from Post Traumatic Stress Disorder and has two young children, but that she is still seeking employment.

I am satisfied the tenant is highly motivated, will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.

Did the tenant comply with their obligations at the end of the tenancy?

The landlord set out the damage that the tenants have caused to the property during this tenancy. It is extensive. As well as the damage that the tenants have agreed to repair, the damage includes broken windows, damage to fences, removal of the security alarm, damage to the electric gate, removal of the garage side door and damage to the laundry floor. The landlord said there are extra people living in the property and more damage is evident at every inspection.

Under section 40(1)(a)-(e), Residential Tenancies Act 1986, a tenant has specific obligations in relation to the tenancy premises.

As already stated, despite the rent arrears and the damage to the property, the landlord is motivated to find a way for the tenants to remain at the property. A work order with an extended time for compliance and no financial consequence for breaching it, is the landlord’s preferred option.

Because this work order is being made with the consent of both parties no monetary order is made as an alternative to compliance with the work order.

The landlord stated that if more damage occurs, they are likely to make another application to the Tribunal which would likely include an application for termination of the tenancy.

Because Shelter Realty Limited As Agent For Sneh Patel has substantially succeeded with the claim I have reimbursed the filing fee.
