The tenant did not dispute the claims for water rates and carpet repairs. These amounts are proved by consent, and are ordered.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The landlord claims the tenant did not leave the premises reasonably clean and tidy. A cleaner was engaged who cleaned the walls and ceilings, the windows, the oven and utility areas, and mopped and vacuumed.
The landlord produced photographs and an invoice for $720.00 in support of the claim. The landlord stated that after the professional clean, the owners personally undertook further cleaning.
The tenant stated that she accepts the oven needed cleaning, and mopping was needed, but she believes she left the rest of the premises reasonably clean and tidy.
The photographs I have seen largely focus on small areas of dirt, such as in the corner of wooden window frames, on top of blinds, inside cupboards, lampshades with fly dirt and raised windows with spider webs. The photographs show the house to be of older style and well used. The photographs are helpful in showing exactly where the dirt is.
In my view the photographs show the premises were probably left by the tenant in a condition close to reasonably clean and tidy. I can see that more cleaning was needed after the tenant left, but that is not unusual, and responsible landlords often undertake a deep clean between tenancies.
I have taken into account the landlord’s and the tenant’s comments and I have awarded an amount that I believe was sufficient to bring the premises up to a reasonably clean and tidy condition.
The amounts ordered are proved.
Because Whangarei Real Estate T/A Harcourts Just Rentals As Agent For Kate & Jordan Smith has substantially succeeded with the claim I have reimbursed the filing fee.
