Tuutasia Penitito Galo, Sauhesset Galo and Telesia Galo must pay Fair Rentals Limited As Agent For Yu Hui Lee $3,419.25 immediately, calculated as shown in the table below:

Only the landlord attended the hearing. The tenants did not attend. They were called on different numbers but no call was connected At the start of the hearing the landlord made a separate attempt to try the tenant on the number ending 123 – he says this was answered and then disconnected. I tried this number again after that but it was not answered. I left a voicemail (this was the only number that did connect in any way) advising I would telephone back but again, on calling back, the line went direct to voicemail.
I am satisfied the tenants have been served and so the hearing proceeded in their absence.
The landlord has applied for termination of the tenancy for rent arrears and refund of the bond, water rates and reimbursement of the filing fee.

Should the tenancy be terminated?

Where a landlord applies to terminate for breach, and rent is at least 21 days in arrears on the hearing date, the Tribunal must terminate the tenancy. See sections 55 and 56(2) Residential Tenancies Act 1986.

The landlord provided rent records which prove the amount owing at the end of the tenancy. The amount ordered is proven. This is the rent arrears to today’s date.
The landlord provided water invoices and a water record for the tenancy. The claim sought payment of invoices for February, March and April. The February invoice is now paid off, the March invoice has arrears of $3.59 (most of the bill having been paid now) and $60.80 is the amount owed for the invoice dated 2 April 2025. It is proven that the sum outstanding for these invoices is $64.39. This is so ordered.
There are also more recent invoices that they landlord says are outstanding for 2 amounts each for $50.67 but they were not included in the application before today.
I cannot make an order in relation to those later invoices as the tenant needs notice that these are part of the landlord’s claim in advance of today. A separate application can be bought for these sums where necessary. Name suppression and filing fee
Because Fair Rentals Limited As Agent For Yu Hui Lee has wholly succeeded with the claim I must reimburse the filing fee.
Name suppression is not sought by the landlord, and I cannot see any basis on which this should be awarded to the tenants (see section 95A RTA) so no suppression orders apply to this decision.
