The landlord attended the hearing represented by Ms Tran.
The tenant did not attend and not answer the calls made to her phone during the hearing. She had been notified of the hearing by email and text, accordingly pursuant to section 92 of the Residential Tenancies Act 1986 (RTA) the hearing continued in her absence.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The tenancy ended on 26 April 2025 by tenant notice. The landlord provided rent records which prove the amount owing at the end of the tenancy. Accordingly, the amount ordered is as sought.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) RTA.
The landlord established in evidence that the tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish when she vacated.
The amount ordered for cleaning and rubbish removal is reduced slightly from that claimed to account for the landlord replacing a mattress protector and undertaking cleaning to a higher standard than that required of a tenant pursuant to section 40(1)(e)(ii) RTA.
This is because mattress protectors only have an estimated life span of approximately a year in New Zealand residential tenancies. This one had been in place the duration of the tenancy which had commenced in October 2023, therefore had fulfilled its expected life span.
Further, the tenant’s statutory obligation is to leave the premises in a reasonably clean and reasonably tidy condition. “Reasonably” clean means clean to the standard an average, reasonable bystander would consider reasonable. 1 This is not necessarily to the standard a landlord considers acceptable for a new tenant. 2
The landlord had claimed for washing the walls and outsides of windows. There was no evidence here as to why the tenant should be responsible for cleaning 1 Housing New Zealand v Holloway TT Auckland TT215/93, 8 February 1993 2 Ace Property Management Ltd v Owens DC Wellington CIV-2008-085-1441, 17 Dec 2008 these areas. In doing so I consider the landlord has cleaned the property to a standard higher than would be expected of the tenant and the circumstances. The amount ordered is what is considered reasonable in light of the evidence.
Because Viaduct City Rentals Limited As Agent For Christopher Simon Templer has substantially succeeded with the claim I have reimbursed the filing fee.
