Reasons

The landlord originally applied for termination, rent arrears, refund of the bond, and reimbursement of the filing fee.

The matter was set down for hearing on 21 July 2025. Both parties attended on 21 July and advised that the tenancy had ended. The landlord sought to add a claim for rubbish removal of $1750. The tenant sought a set off against the landlord claims due to leak issues at the property.

The claim was amended, and the hearing was adjourned for further time and to allow both parties to file further evidence.

The landlord has filed further evidence, but the Tribunal has not received evidence from the tenants.

Only the applicant landlord attended the hearing today.

The landlord has filed evidence of the premises being reroofed and a copy of the Healthy Homes Report. As the tenants have not filed evidence and has not attended today the tenant set off claim cannot proceed.

I will consider the landlord claims.

How much is owed for rent?

The tenancy ended on 12 May 2025 when the landlord became aware that the tenants had vacated the premises. The landlord provided rent records which prove the amount owing to 12 May 2025 is the sum of $4142.12.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.

The landlord claimed that the tenants did not leave the premises reasonably clean and tidy and did not remove all rubbish.

The landlord provided a photograph of the carport taken during the tenancy when the property was being reroofed and photographs taken on 13 June 2025 after the tenancy ended. The landlord provided evidence of a payment for rubbish removal on 26 June 2025 in the sum of $1750.00.

I am satisfied that it is more likely than not that the tenants did not remove all rubbish as items such as a fridge and tyres showing in the photograph taken during the tenancy are present in the photographs taken after the tenancy ended. However, as the landlord did not do a final inspection until 13 June 2025, the rubbish removal was not done until more than one month after the tenancy ended and there is no itemised invoice I am not satisfied that the tenants are liable for the full amount claimed. I order the tenants to pay half of the amount claimed being $875.00. Filing fee

Because Legacy Portfolio Management Limited As Agent For Minesh Rainga has substantially succeeded with the claim I have reimbursed the filing fee.
