The landlord has provided evidence of the cost of rubbish removal, and I am satisfied that this claim is proved.

Is the tenant responsible for the cost of removing an addition to the premises?

Kāinga Ora–Homes And Communities claims the tenant has failed to return the premises to a condition that was substantially the same as the condition prior to a change being made by the tenant.

On or before the expiry of a tenancy the tenant must return the premises to a condition that is substantially the same as the condition the premises were in prior to the change being made. See 42B(4) Residential Tenancies Act 1986.

The tenant erected an additional structure attached to the garage. The tenant did not remove this structure at the end of the tenancy. The landlord removed the structure at a cost of $214.05. The landlord provided evidence of the addition during the tenancy and of the cost of removal. I am satisfied the claim is proved and order the tenant to compensate the landlord for the cost of removing the structure. Suppression

Section 95A (4) Residential Tenancies Act 1986. Having considered the factors in this case the Tribunal orders suppression of the tenant details to be consistent with the earlier order of the Tribunal dated 3 March 2025 which granted suppression.
