The photographs also showed some brown marks and patches on the carpet. I am satisfied that the carpets required cleaning at the end of the tenancy. The landlord provided an invoice for $184 for carpet cleaning.

The tenant had replaced the front door lock and then taken it with him. The remaining lock did not have the right key. The back door lock was damaged. The landlord submitted invoices for $60.51 and $59.57.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.

The landlord provided entry inspection photos and exit inspection photos.

The photos showed that at the end of the tenancy, there was damage to the back door. The landlord submitted an invoice for $252.00.

The landlord sought a further $1,033.40 for damage incurred during the tenancy. During the hearing, a prior order for $930.27 was reviewed. The tenant had accepted responsibility for this and had made repayments totalling $120. That means that $810.27 remains on that order.

The property manager said that there was a further amount of $155.25 for broken glass that had happened after the prior order. This amount had been invoiced to him. She was asked to provide evidence of that by lunchtime, which she did. The amount ordered is proved.

The damage was caused during the tenancy and is more than fair wear and tear, and the tenant has not disproved liability for the damage.

I have taken into account betterment and depreciation. The landlord should be returned to the position they would have been in had the tenant not breached their obligations, and should not be better or worse off. In calculating depreciation, I have taken into account the age and condition of the items at the start of the tenancy and their likely useful lifespan.

Although the application referred to some other items: kitchen cabinet, garage door and bedroom door, no further evidence was available to the property manager. Those matters are withdrawn.
