Lofia Nau must pay rent and the debt as follows: a. Paying the weekly payments of $625.00 tomorrow Tuesday 9 September 2025 and then weekly rent must be paid every Tuesday until the rent arrears are paid in full. b. In addition to weekly rent a lump sum payment of $1,225 for the rent arrears must be paid by Friday 19 September 2025. c. The water arrears and filing fee (total $229.78) must also be paid by 19/9/2025.

Payments will be allocated in the following order: rent, rent arrears, water arrears and the filing fee.

If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at 613A Massey Road, Mangere, Auckland 2022 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

If the tenant fails to pay the water arrears and filing fee within 2 working days of the due date, the filing fee and water invoices will be payable immediately.

Reasons

Only the applicant landlord attended the hearing.

The tenant did not join the video call and could not be contacted by telephone.

The landlord has applied for termination of the tenancy, rent arrears, water arrears and refund of the bond.

The landlord is prepared to give the tenant one final opportunity to pay the debt and despite her non-attendance it is assumed the tenant wants to repay the debt to avoid immediate termination.

Should a conditional termination order be made?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days, and establish that the tenant has failed to do so. See section 56(1) Residential Tenancies Act 1986.

The tenant breached their obligations by failing to pay the rent and water charges as they have fallen due. On 19 June 2025 the landlord served a 14- day notice on the tenant but the breach was not remedied within the required period. It would be inequitable to refuse to terminate the tenancy, as the rent has been in arrears almost since the beginning of the tenancy. There is now also a persistent failure to pay water charges for water used at the property which the tenant also agreed to pay when she signed the tenancy agreement.

Despite my finding that it would be inequitable to refuse to terminate the tenancy, having considered the evidence and the landlord’s submission that one final opportunity can be provided to the tenant to pay the overdue rent amount, I have granted a conditional termination. See section 78(3) Residential Tenancies Act 1986.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order is enforceable for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.

Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee and approve the applicant’s request for a name suppression order.
