The landlord attended the hearing by video. The tenant did not join the video link. The Tribunal called the tenant on two different cell phone numbers provided in the application and as advised by the landlord at the hearing. The calls diverted to voicemail. I am satisfied that the tenant received notice of the heraing and did not attend.

The landlord has applied for a monetary order for rent arrears, and water rates owed for the tenancy.

How much is owed for rent and water rates?

The landlord provided rent records and water rates invoices which prove the amount owing.

The rent week starts on a Saturday and ends on a Friday. This means that in respect of each week rent is due on the Saturday at the start of each week. Rent must also be paid in advance as provided in the tenancy agreement. For example, for the rent period commencing on Saturday 20 September and ending on Friday 26 September 2025, rent of $750 is due for payment on Saturday 20 September 2025.

There are two problems with the tenant’s rent payments. The first is that up until 27 December 2024, the tenant was $700 in credit on the rent statement. Therefore, to use up the credit, the tenant did not pay rent of $750 for the week starting 28 December 2024 and ending 3 January 2025. However, this resulted in arrears of $50 which has continued since that date.

The second problem with rent payments is that the tenant has been making rent payments up to 6 days late. This started when for the period 4-10 January 2025 the tenant did not pay rent until 9 January 2025 which is 6 days late. This problem has continued since then. As at the hearing date, the tenant has still not paid rent for the current week which runs from 13-19 September. The rent of $750 was due to be paid on 13 September 2025. Adding this amount to the ongoing arrears of $50 means that rent is in arrears of $800 for the current rent week which ends on Friday 19 September 2025.

To bring her payments into alignment and to comply with the obligation to pay rent in advance as provided in the tenancy agreement, the tenants needs to pay $800 to cover the arrears for the week ending Friday 19 September 2025. Then the tenant needs to pay $750 by Saturday 20 September 2025 to cover next week’s rent for the period 20-26 September 2025.

The orders made are to bring payments into alignment as explained above.

In addition, the tenant must pay the water rates owed.

Because the landlord has succeeded with their application, they are entitled to reimbursement of the filing fee on this application.
