The tenancy was a fixed term tenancy until 1 March 2026. The tenants asked to be released from the tenancy early and agreed for the landlord to find replacement tenants.

A new tenancy started on 28 July 2025. Law

Neither party can give notice to end a fixed term tenancy, except in limited cases which are not relevant here. A fixed term tenancy usually ends by agreement between the parties or by order of the Tribunal.

A tenant may request a landlord to be released from a fixed term tenancy. The parties can reach agreement about how the tenancy will end.

Here, the landlord set out the terms on which it would agree for the tenancy to end. The tenants would be liable for the costs incurred finding a new tenant and would remain liable for rent until a new tenancy started. Findings

The landlord has proved a claim for rent arrears by the production of rent records. Mr Bhandari accepted the landlord’s rent claim. The landlord has claimed rent arrears until 23 July 2025 only.

The landlord incurred costs finding a new tenant. The tenants are liable for reasonable costs incurred by the landlord to find tenants, which in turn reduced their liability for rent. Mr Bhandari accepted the costs claimed by the landlord.

The costs claimed by the landlord (referred to as ‘break lease’ costs) are objectively reasonable for the work required.

The landlord sought loss of rent compensation being the difference in rent between the rent these tenants paid and the rent the new tenants will pay.

Mr Bhandari said he was not asked about a rent decrease, nor did he agree to that. However, without the rent reduction (which reflects the shift in market rents) the tenants would have remained liable for rent for longer.

When the Tribunal awards loss of rent compensation is only does so up to the date of the hearing. The Tribunal cannot predict what might happen between now and the end date of the current tenancy. The new tenants might also leave the tenancy and the landlord might find replacement tenants who pay a higher rent, so their actual loss is only an assumed one at this time.

I have therefore awarded loss of rent compensation for a period of 9 weeks only.

As the application is successful, I award reimbursement of the filing fee the landlord paid. Result

The bond will be paid to the landlord. After the deduction of the bond, the tenants will pay the landlord $1,937.38. Name suppression

On my enquiry, neither party sought a name suppression order.
