A hearing was convened by teleconference today. The landlord’s representatives attended. The tenant did not appear, despite multiple attempts to contact her. I am satisfied that the hearing notice was properly served. It was therefore appropriate to proceed in the tenant’s absence.

The landlord provided photographic evidence, an exit inspection report and a detailed invoice in support of their claim for compensation.

The landlord’s evidence establishes that the premises were left dirty, with food remnants, pet odours, stains on the carpet, and general disarray. A cleaner was engaged for five hours and provided a statement describing the poor condition of the premises, including mulched chewing gum in the carpet, strong odours, and broken blinds.

I find that the premises were not left reasonably clean and tidy. The standard required is not perfection but “reasonable cleanliness.” The photographs and evidence satisfy me that this threshold was not met.

The evidence, including pet odours and visible staining, also supports the need for carpet cleaning.

The property is a 1,034m² site with substantial gardens and green space. The evidence shows overgrown paths, weed infestations, and unkept lawns. The landlord’s claims for mowing, weeding and general garden clean-up including the breakdown of time and costs are supported by photos.

The landlord has claimed for lock and padlock replacement due to keys not being returned. There is clear evidence from the exit inspection that no keys were returned. The replacement cost is confirmed, and I accept this as fair and award it in full.

The landlord claims costs for plastering, sanding, and repainting where a TV mount was removed, and for replacing blinds which were broken at the end of the tenancy. While the landlord concedes that blinds may have originally been replaced by the tenant, the photos show damage requiring remedy. I accept these costs as reasonable and supported by the photographic evidence and testimony provided. I am satisfied that the damage exceeds fair wear and tear and that the tenant has not disproved liability. The tenant is liable for the costs claimed. Filing fee

As the landlord has been wholly successful, I award reimbursement of the filing fee under section 102(4) of the RTA.
