Reasons

Both parties attended the hearing.

The landlord applied for rent arrears, water rates, and insurance excess due to damage.

The tenant withdrew from the tenancy due to family violence 1 . The last day of the tenancy was 10 February 2025.

The landlord sought rent arrears for the period up to 13 February 2025 as there were other people living at the premises on termination of the tenancy. Those people were not tenants and therefore had no legal right to occupy the premises.

The Tribunal is not able to award rent arrears against the tenant after the withdrawal date. The landlord’s claim for rent arrears is from 7 February 2025 and therefore I have awarded rent arrears from that date up until 10 February 2025.

The landlord claimed for water rates and provided the water invoices. The amount ordered is proved.

The landlord claimed for damage due to methamphetamine contamination. There was no pre tenancy methamphetamine testing and the highest methamphetamine test result at the end of the tenancy was 4 μg/100cm².

The landlord must prove, on the balance of probabilities, that any methamphetamine contamination occurred during the tenancy in question. If there is no pre-tenancy methamphetamine test, it is usually not possible to prove that contamination occurred during the tenancy, rather than before it.

Even if there were pre-tenancy testing in this case, the accepted threshold for methamphetamine contamination is based on the Gluckman report (15 μg/100cm²). If methamphetamine levels are below the Gluckman threshold, the premises are not considered contaminated for the purposes of the Residential Tenancies Act 1986.

The landlord’s claim for damage due to methamphetamine contamination is dismissed.

The landlord claimed for damage to the carpet, door and paintwork. However, the landlord has not provided any photographs, invoices, or other documentary evidence to support the claim. The Tribunal requires clear evidence to establish that damage occurred, the extent of the damage, and the cost of repair or replacement.

In the absence of such evidence, I am not satisfied that the landlord has proven, on the balance of probabilities, that the tenant caused the alleged damage or 1 Section 56B Residential Tenancies Act 1986 that the claimed amount is reasonable. Accordingly, the claim for compensation for damage is dismissed.

Because Ora Investments Limited has substantially succeeded with the claim I have reimbursed the filing fee.

Pursuant to section 95A of the Residential Tenancies Act 1986, I order that the name and identifying details of the tenant are suppressed and must not be published. This order is made on the grounds that the tenant has withdrawn from the tenancy due to family violence, and suppression is necessary to protect the privacy and safety of the tenant. Publication of the tenant’s details would be contrary to the interests of the parties and the public interest in cases involving family violence.
