How much is owed for rent?

The tenancy ended on 11 May 2025. The landlord provided rent records which prove the amount owing at the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

The tenant did not leave the premises reasonably clean and did not remove all rubbish as required by section 40(1)(e)(ii)-(v) of the Residential Tenancies Act 1986 (the Act).
The amounts ordered are proved. The landlord completed the cleaning and rubbish work themselves. When a landlord does work on the property themselves an hourly rate of $25.00 is considered reasonable. The amount claimed to remove rubbish and clean the premises has therefore been reduced to reflect the lower hourly rate for the landlord’s labour.

Is the tenant responsible for the damage to the premises?

To be successful in a claim for damage to the premises, the landlord must prove that damage occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they, or others at the premises with their permission, did not carelessly or intentionally cause or permit the damage: sections 40(2)(a), 41 and 49B of the Act.
The landlord has established that the following damage was caused during the tenancy: • Walls in all rooms, other than the bathroom, kitchen and laundry, were damaged by gouges, holes (some of which the tenant had attempted to repair), and damage caused when Sellotape and the like were removed. • An exterior door was damaged (glass broken and frame damaged) and replaced by the tenant with a door that was also damaged and did not fit well.
The damage is more than fair wear and tear, and the tenant has not disproved liability for it.
The amounts ordered are proved by the production of invoices.
I have taken into account betterment and depreciation with respect to the painting of the walls. The landlord should be returned to the position they would have been in had the tenant not breached their obligations and should not be better or worse off. In calculating depreciation, I have taken into account when the walls were last painted (Mr Bowden said that they were likely last painted approximately 5 ½ years ago). Painted walls are expected to last approximately 10 to 12 years before requiring repainting. I have therefore reduced the amount claimed for painting the walls ($2,000.00) by 45%.
The landlord has been successful in its claims and is therefore entitled to payment of the Tribunal application fee.
