[The tenant/s] owes The Rent Shop Limited as agent for Wen Chi Zhao & Ming Shun Chen $3,467.34 (“the debt”), as set out in the table below:

[The tenant/s] must pay rent and the debt as follows: a. by a payment of $950.00 by 11.59pm on Wednesday 19 November 2025 in reduction of the rent arrears owed; b. a payment of $39.34 by 11.59pm on Wednesday 19 November 2025 for water rates c. in addition to $550.00 being paid each week for current rent, an extra $150.00 for the debt is to be paid each fortnight. These payments shall begin on Saturday 29 November 2025 and continue each Saturday fortnight until the debt has been paid in full.

Payments will be allocated in the following order: rent, rent arrears, and the filing fee.

If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at 33A Limond Street, Randwick Park, Auckland 2105 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

If the tenant fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.

Reasons

In making my order dated 19 November 2025 I made an error as: a) I did not include payment of rent in order 2.c. above, and b) I stated that the additional payment towards the debt was to be paid fortnightly commencing on Tuesday 2 December. The payments are due on Saturday as that is the start of the rent week. The tenant has 2 working days after each Saturday they are due, therefore must make the payments by the Tuesday following to meet the terms of the conditional termination. Apart from the above, the “Reasons” section of my order remains the same:

Both parties attended the hearing which was held by video.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The tenant wants to repay the debt to avoid immediate termination.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The tenant wants to repay the debt to avoid immediate termination.

Should a conditional termination order be made?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days, and establish that the tenant has failed to do so. See section 56(1) Residential Tenancies Act 1986.

The tenant breached their obligations by failing to pay rent. On 1 July 2025 the landlord served a 14-day notice on the tenant but the breach was not remedied within the required period. It would be inequitable to refuse to terminate the tenancy due the mount of rent in arrears.

Despite my finding that it would be inequitable to refuse to terminate the tenancy, having heard the evidence I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further breach. I have granted a conditional termination. See section 78(3) Residential Tenancies Act 1986.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order is enforceable for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.

As the landlord has wholly succeeded with the claim I must reimburse the filing fee.
