The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
The landlord’s claim was not well structured or presented. A landlord must identify each specific claim (rent arrears and compensation), quantify each claim, and provide the evidence to support each claim. A rent summary should only include rental transactions and payments towards the rent.
The landlord has the obligation of proving each of its claims.

How much is owed for rent?

The tenancy ended on 21 April 2025. The landlord provided rent records which prove the amount owing at the end of the tenancy.
Mr Kelly disputed the amount claimed. He thought some rent may be owing but not the amount claimed. He also said that the landlord had acknowledged that he does not owe arrears, but he cannot access that email anymore.
Mr Kelly did not provide any evidence to show that he has paid more than the payments shown on the rent summary.
The claim for rent is proved. The landlord also acknowledged that Mr Kelly was entitled to a credit of $326.16 for work he did for the landlord. Mr Kelly seemed to suggest that the credit should have been more but did not provide any evidence to explain or prove that.
The landlord also claimed cleanings costs and power charges but did not provide any invoices from its suppliers to prove those claims. It had a quote for cleaning but no receipt or invoice. The claims for cleaning and power were not proved and are dismissed.
The landlord was partially successful, so I have awarded reimbursement of the tribunal application fee. The landlord failed with some of its claims, I have not granted its application for suppression.
