Reasons

I issued an order on 1 October 2025 requiring the tenant to pay for the replacement of the key and lock in the amount of $103.40.

On 7 October 2025, the landlord’s property manager, Ms. Faiers, filed an application for rehearing. Her reasons, as stated in the application, were as follows: During the original hearing on 1st October I was asked to provide further evidence to support our claim for compensation of costs. At that time, no timeframe was given for this submission. I subsequently attended off-site appointments and unfortunately did not see the follow-up email requesting the evidence by 3.30pm on the same day. The evidence was submitted promptly the following morning at 9.13am. At that stage I was advised the application had already been closed. Given these circumstances, we request respectfully that our submitted evidence be considered toward the remaining compensation of $2,099.41, being 2 x Bin Boys invoices for $499 and $499, Clean Planet invoice for $262.50, KP Builders (for rubbish removal) of $838.91, plus the application fee of $27 (sic). As you can see from the submitted evidence, the property was left in a significantly poor state, and we believe the evidence is critical to ensuring a fair and just outcome for this matter.

I did not specify during the hearing the time by which Ms. Faiers was required to file her evidence. Upon realising this, I issued a direction for her to file the evidence by 3:30 p.m. on the same day as the hearing.

Unfortunately, she had another appointment to attend. I believed no further evidence was to be submitted, and on that basis, I issued an order awarding the landlord $103.40 for the lock/key replacement.

Because I did not initially specify the timeframe for filing evidence and was unaware that Ms. Faiers had another appointment after the hearing, I issued the order without considering her evidence.

On that basis, I consider that “a substantial wrong or miscarriage of justice has or may have occurred or is likely to occur” pursuant to section 105(1) of the Residential Tenancies Act 1986 (“the Act”).

Accordingly, the rehearing application is granted.

I now turn to the substantive hearing of 01 October 2025.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.

Ms Faiers submitted that Mr Paea did not leave the premises in a reasonably clean and tidy condition when vacating on 13 May 2025. She also stated that no keys were returned at the end of the tenancy and that the property required professional cleaning.

Ms Faiers also stated that significant quantities of rubbish had been left behind. She explained that Mr Paea had removed items from inside the house and stored them in the garage. As a result, Ms Faiers had to hire two skip bins and also engage a builder to remove additional rubbish by trailer.

During the hearing on 1 October 2025, I informed Ms. Faiers that I had the invoices showing that the money was spent, but there was no supporting photographic evidence for the claims. I also advised that I would have no issue awarding compensation if photos and/or the final inspection report were filed with the Registry after the hearing.

I now have the supporting photographic evidence for the claims and have reviewed all the evidence.

Accordingly, I am satisfied that Mr Paea failed to leave the premises reasonably clean and tidy, and/or that he failed to remove all rubbish.

The amounts ordered are proved. Filing fee

Because Eves Realty Limited has wholly succeeded with the claims, I must reimburse the filing fee.
