Katie Dunne and Antonio Bilotto must pay $2,101.55 to the Landlord immediately, as calculated in the table below.
This order supercedes the Tribunal’s previous Order for application 5266548, dated 21 July 2025..

Reasons

This application was scheduled to be heard by video conference. Neither of the tenants appeared via the Teams link and calls I made to their phones went unanswered. Texts to the property manager from Ms Dunne during the hearing indicate that she was aware of the hearing.
The hearing proceeded in the tenants’ absence.
The landlords have applied for outstanding rent, outstanding water rates and reimbursement of the filing fee. They have also applied to have the tenancy terminated.
I accept the rent record and water invoices which prove the amount owing as at today’s date and reflected in the table above. I note that the last payment of rent was $900.00 paid yesterday, 20 August 2025.
I am also ordering the tenants to reimburse the filing fee to the landlord because the landlord was substantially successful with the claim against them.
The tenants are required to pay these amounts immediately.
I am dismissing the application to terminate the tenancy.
The Tribunal can terminate a tenancy for rent arrears if the rent is more than 21 days in arrears on the day the application was filed or on the day the application is heard.
The tenants were not 21 days in arrears on either of these dates.
The Tribunal can also terminate a tenancy for rent arrears if the landlord has issued the tenants a 14 day notice to remedy the arrears and the tenants have failed to remedy within that 14 day period.
On 11 August 2025 the landlord issued the tenants with a 14 day notice to remedy the arrears. That 14 day period has not yet expired and so the tenancy cannot be terminated on this ground either.
However, I note that at today’s hearing Ms Dunne communicated by text with the property manager. While I was unable to talk to Ms Dunne in person, and therefore unable to incorporate the discussion into an Order, I accept the evidence that in those texts she agreed to pay the landlord $900.00 per week until the rent arrears are paid in full. With reference to the date on which Ms Dunne is paid, the amount owing as at next Wednesday 27 August 2025 will be $2,310.00 and the $900.00 weekly payments are to commence on that day.
Again, this arrangement is not a formal Order by the Tribunal. It is an understanding between the parties.
Further to this, I am allowing the landlord’s application to have their name and identifying details suppressed because they were substantially successful with the claim. C ter Haar 21 August 2025
