Reasons

The landlord attended the hearing represented by Mr Galbraith. Mr Galbraith is Ms Wilkes’ partner. He had not been formally approved as a representative pursuant to section 93 of the Residential Tenancies Act 1986 (the Act), however he provided evidence that he had acted as Ms Wilkes’ agent throughout the tenancy. He had engaged with the tenants and was fully appraised of the circumstances.
Accordingly, pursuant to s85 of the Act, I consider it expeditious to enable his representation of Ms Wilkes at the hearing.
The tenants did not attend the video hearing and not answer the calls made to both their phones during the hearing. They had been notified of the hearing by email and text and had the hearing link, however did not attend. Accordingly pursuant to section 92 of the Act, the hearing continued in their absence.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent and electricity?

The tenancy ended on 5 July 2025 by consent. The landlord provided rent records and electricity invoices which prove the amounts owing at the end of the tenancy.
The tenants were supposed to change the electricity supply into their own names at the beginning of the tenancy but did not. The landlord continued their own supply in an act of goodwill.
I am satisfied, having considered the evidence and section 39 of the Act, that the tenants are liable for the electricity charges.

Did the tenant comply with their obligations at the end of the tenancy?

The landlord seeks reimbursement of the cost they were put to in having the property cleaned at the end of the tenancy. They have provided photographic and text evidence to establish that the property was not left clean when the tenants vacated, and the tenants agreed to pay the cleaning charge.
Pursuant to section 40(1)(e)(ii)-(v) of the Act, at the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit.
Having considered the evidence provided, I am satisfied that the tenants did not leave the premises reasonably clean and tidy when they vacated the tenancy. I consider the amounts sought reasonable in light of the circumstances.
Because [The tenant/s] landlord/s] has wholly succeeded with the claim I must reimburse the filing fee.
