The hearing was conducted by teleconference on 23 September 2025.

Ms. Eder, representing Kainga Ora as property manager, attended the hearing. The tenant, Ms. Manuel, was not in attendance at the scheduled start time.

At 11:18 a.m., I attempted to contact Ms. Manuel on her listed number. The call was not answered, and I left a voicemail identifying myself as the adjudicator, noting the time, and advising that I would call her again at 11:25 a.m.

At 11:25 a.m., I made a further attempt to contact Ms. Manuel. Again, the call was unanswered, and I left a second voicemail advising that I would be proceeding with the hearing in her absence.

Before the hearing, the case manager had been in touch with Ms Manuel, according to the Kainga Ora record. a. On 28 August 2025, Tenancy manager Ms Lee spoke with Ms Manuel about rent arrears and explained the Tenancy Tribunal application. b. On 30 August 2025, Ms Manuel contacted Kainga Ora regarding upcoming maintenance work. c. On 4 September 2025, Ms Manuel phoned the contact centre requesting installation of a deadbolt lock. d. On 9 September 2025, Kainga Ora sent Ms Manuel a text advising that a deadbolt lock would not be installed for health and safety reasons. e. On 11 September 2025, the tenancy manager advised Ms Manuel by phone that the Tribunal hearing was scheduled for 11:15 a.m. on 23 September 2025, and reminded her of rent payment expectations. Rent arrears and potential risk to the tenancy were discussed. f. On 15 September 2025, Kainga Ora sent Ms Manuel a text about her rent arrears and recommended she set up an automatic payment.

Ms. Manuel did not attend the hearing or seek an adjournment, and accordingly, the matter proceeded in her absence. Termination

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.

Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.

From the contact record in paragraph 5 above, Ms Eder explained that Kainga Ora had hoped to work with Ms Manuel because her rent arrears had reduced since the application was filed.

Ms Eder noted that: a. When the application was filed on 14 August 2025, the arrears were $881. b. By the day before the hearing, the arrears had reduced to $388, plus $13 for today, making $401 in total.

Ms Eder described that as “a bit of an effort” on the tenant’s part and said Kainga Ora wanted to support her to continue if possible. But, she also stated that if Ms Manuel did not participate in the hearing, Kainga Ora would ask for immediate termination and possession, since the Tribunal would not be in a position to impose conditions without the tenant’s input.

Ms Eder was correct that Ms Manuel would need to satisfy me that she could pay her rent arrears and that she would not commit any further breach. See section 55(1A) Residential Tenancies Act 1986.

Because Ms Manuel did not attend the hearing, I must terminate the tenancy, as the rent was at least 21 days in arrears on the date the application was filed.

The landlord provided rent records which prove the amount owing at the end of the tenancy. Filing fee

Because Kāinga Ora–Homes And Communities has wholly succeeded with the application, I must reimburse the filing fee.
