Both parties attended the hearing which was held by teleconference. The tenant had the assistance of a support person/ translator.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.

Should the tenancy be terminated?

The Tribunal is required to terminate a tenancy where the rent is more than 21 days in arrears when the application was filed. That is the case there and the arrears have increased since then.

The tenants do not dispute the rent arrears or water rates claimed, although the water rates compensation ordered takes account of the landlord passing on to the tenants a late payment fee which is the landlord’s responsibility.

The tenants ask that the termination date be in a week’s time to allow them time to make arrangements to move. The landlord agrees that the tenants have been very good tenants and that difficulties with the rent have only arisen since [one of the tenants] workplace closed down and he lost his job. Nevertheless, the property manager points out that the arrears are significant and will increase if termination is not immediate.

Language and other barriers have made it difficult for the tenants to get the income support they are entitled to but their support person confirms that those approaches have been made and WINZ have apologised for failing to provide proper assistance to them.

The landlord’s application acknowledges receipt of a bond of $4,780.00 from the tenants. I could find no record of the bond being held at the Bond Centre and gave the landlord until the end of the day to provide the bond number. The landlord has since confirmed that an administrative oversight led to the bond not being lodged. That is an unlawful act for which exemplary damages of up to $1,500.00 may be awarded.

I am satisfied that the bond was not lodged through administrative oversight rather than more widespread unlawful practices on the landlord’s part.

In the particular circumstances of this case, I would not find it just to make an award of exemplary damages against the landlord for its failure to lodge the bond. An appropriate and more meaningful recognition of that wrongful act for the tenants, would be to defer termination of the tenancy to 14 October.

The tenants ask for name suppression. Although they have breached their obligation to pay rent and the arears are serious, the evidence shows that they have a long history of being excellent tenants and these circumstances, which cause them considerable grief, are beyond their control. I find that the grounds for suppression in s.95A(4) RTA are satisfied.

Because A Cube Rentals Limited has succeeded with the claim I must reimburse the filing fee.
