The applicant has provided rent and water records showing the amounts owing to the end of the tenancy. I am satisfied that these records are accurate. The rent and water arrears are awarded.

Is the respondent liable for the carpet cleaning costs?

The applicant has provided photographic evidence showing staining in multiple areas of the property as well as a burn mark caused by an iron. The applicant tells me, and I accept, that the extent of the staining amounts to careless damage, and that the placement of the iron which caused the burn mark similarly constitutes careless damage.
The excess recorded in the tenancy agreement is $1,000. The claims made are for three invoices: $180.00 for carpet materials purchased, $730.25 from the carpet repair company who patched the carpet and removed the staining, and a further $287.50 invoice from a company who initially attempted the work but was unable to complete it.
I do not consider it fair to award an additional carpet cleaning invoice. It appears that further cleaning was required by the subsequent company for the same staining.

It does not need to be perfect, but if it falls short of that standard, the landlord is entitled to carry out cleaning and recover the reasonable costs from the tenant.
The landlord has provided photographs. For the most part, the property has been left in a reasonably clean and tidy condition. However, the tenant did not vacuum the property, did not clean the shower, and there is mould build-up on the windows. For these reasons, I am satisfied that the tenant has breached this obligation, and the cleaning costs are awarded.

Is the respondent liable for the modem?

The applicant has told me that the internet system in this building requires a particular type of modem. This requirement was explained to the tenant and is recorded in the entry inspection photos. At the conclusion of the tenancy, the tenant returned the property without this modem, and the landlord was required to import a replacement from Australia.
I am satisfied that the landlord’s account is accurate. They have provided the invoice for the replacement modem, and the amount sought is awarded. The filing fee:
