The tenancy of Doreen Sione at Unit/Flat Flat 2, 8 Jack Browne Place, Otahuhu, Auckland 1062 is terminated, and possession is granted to [The landlord/s], at 6pm on Wednesday 13 November 2025.
The Bond Centre is to pay $1,362.31 from the bond of $1,600.00 ([Bond number suppressed]) to [The landlord/s] immediately.

Reasons

Only the applicant landlord attended the hearing. The tenant did not answer multiple calls to her cell phone number.
The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.
Where the breach is capable of remedy, the landlord is required to serve a 14- day breach notice on the tenant and the tenant has failed to remedy the breach.
The legislation requires the landlord to have warned the tenant about the likely consequences of continued breach before it will exercise its discretion to terminate.
The tenant has breached their obligations by failing to pay the rent as it fell due. A 14 day notice was served on 5 September and the tenant failed to remedy the breach.
It would be inequitable to refuse to terminate the tenancy as the rent has been in arrears since last December and despite repeated warnings of the consequences of failing to pay rent (and water invoices) as it falls due the rent remains significantly in arrears. It is also relevant that the tenant is refusing to communicate with the landlord and did not answer the Tribunal calls today.
The Tribunal notes that the landlord indicated that the termination clause may not be enforced IF the tenant pays all arrears (of water and rent) by Wednesday and also pays the one weeks rent in advance she is required by her tenancy agreement to pay by Wednesday. The decision not to proceed with termination is now one that is at the landlord’s sole discretion.
The application is successful so the requests for name suppression for the landlord and for reimbursement of the filing fee are both approved.
