Order
- Pavel Skachkov must pay Max Rentals Nz Limited As Agent For Kunal Patel $14,788.85 immediately, calculated as shown in table below.
Reasons
- The hearing proceeded by way of telephone conference. Mr Baig, Property Manager, and Mr Dogar, Branch Manager, appeared for the landlord. Unsuccessful attempts were made to join the tenant to the hearing by telephone. The Tribunal was satisfied the tenant was properly served with the notice of hearing and the case proceeded in their absence.
- The tenancy commenced on 18 January 2024 with the fixed term ending on 15 January 2025. Thereafter, the tenancy became periodic.
- On tenancy ended on 20 August 2025 after the tenant gave notice.
- On 8 September 2025, the landlord filed an application seeking rent arrears and outstanding water rates following the end of the tenancy.
- The onus of proving these claims rests with the landlord. The standard required is on the balance of probabilities. The landlord must establish more likely than not that the tenant has breached the terms of the agreement or provisions of the Residential Tenancies Act 1986 (the “Act”).
How much is owed for rent and water rates?
- The landlord seeks outstanding rent arrears totalling $14,630.00 following the end of the tenancy. The Tribunal was provided with an up-to-date rent summary which proved the amount owed. The amount claimed is ordered.
- The landlord seeks outstanding water rates totalling $130.35 and a water rates bill and tenant invoice was provided to prove the amount claimed. The Tribunal was told the water rates invoice was sent to the tenant’s e-mail address for service on 26 August 2025 and the amount claimed remains outstanding. The amount claimed is ordered. Costs
- Because Max Rentals Nz Limited As Agent For Kunal Patel has wholly succeeded with the claim I must reimburse the filing fee. Name suppression
- Despite being wholly successful the landlord did not seek name suppression.
