The hearing was conducted by telephone. Mr Pulumati of Kaso Property Management Limited attended the hearing for the landlord. Mr K Gaundar and Mrs N Gounder attended the hearing. I tried calling the third tenant, Mr N Gaundar, at the start of the hearing, but the call went to answerphone. Mr K Gaundar confirmed he had authority to speak for Mr N Gaundar.

The landlord has applied for termination of the tenancy, rent arrears and unpaid water rates.

How much is owed for rent?

The landlord provided rent records showing that as at today’s date the amount owing for rent arrears is $2,985.71. The tenant acknowledges that they are in arrears but disputes the amount the landlord said is owing. The tenant was asked to provide evidence of this and said he would need to check his bank account details.

The tenant has had not notice of the landlord’s application since September 2025 and notice of this hearing since 14 November 2025. The landlord sent the most recent rent ledger to the Tribunal, copying the tenant last night. However, since lodging the application in September this year, the landlord has provided regular updated ledgers showing the rent owed. Any evidence supporting the tenant’s assertion that the amount of rent owed should have been produced prior to or during the hearing.

On the basis of the evidence available to me, I am satisfied that the amount of rent owed is $2,985.71. This claim is proved.

The parties agreed that $1,147.43 is owed for unpaid water rates. This claim is proved.

Should the tenancy be terminated?

Section 55(1) of the Residential Tenancies Act 1986 (RTA) provides that where an application is made under this section for termination of the tenancy and the rent was on the application date at least 21 days in arrears, the Tribunal shall make an order terminating the tenancy.

Section 55(1A) of the RTA provides that if the Tribunal is satisfied that the tenant will pay the rent arrears within a specified time frame and that it is unlikely the tenant will fall into arrears again, then the Tribunal may issue a conditional termination order.

The landlord’s application was filed on 11 September 2025. The landlord has provided a rent ledger showing that the tenant is in arrears and, at the date the application was made, rent was at least 21 days in arrears. The landlord asked for a conditional termination order. However, the tenant disputes the amount of rent owed. Therefore, I cannot be satisfied that the rent owed will be paid by the tenant within a specified period and it is not open to me to make a conditional termination order.

The tenancy is terminated in accordance with section 55(1)(a) of the RTA. Filing fee:
